Since the National Human Rights Commission of Mongolia (NHRCM) and the General Executive Agency of Court Decisions (GEACD) have reached a concrete achievement during their fifteen years of cooperation, the NHRCM and the GEACD have decided to renew their Memorandum of Understanding (MOU) on 11 December 2017. The ceremony of signing on the MOU involved Mr. Byambadorj Jamsran, Chief Commissioner, Ms. Oyunchimeg Purev, and Commissioner, Mr. Ganbayar Nanzad, Commissioner from the NHRCM, and Brigadier General Mr. Amgalanbayar Ts., Head of the GEACD and Colonel Mr. Nyamgombo B., Head of Administration Management Department of the GEACD.
The Memorandum of Understanding was renewed for a term of three years and it has the following objectives:
-To ensure and protect the rights of participants of activities carried under the execution of court decisions in accordance with the Constitution of Mongolia and other international human rights conventions as well as other relevant legislations;
-To prevent from human rights violations caused by the activities taken place during the course of detain, arrest, and confinement;
-To establish and form the human rights-based approach in the execution of court decisions; and
-To strengthen the cooperation between two parties.
Main areas of the cooperation are human rights training, promotional activities, and inquiries. Every year, two parties collaborate in line with their cooperation plan. For instance, based on the achievements and progress from the bilateral cooperation, the NHRCM and the GEACD are planning to undertake the following activities within the framework of renewed MOU:
-Co-organize a nation-wide capacity building training for staff of the GEACD through its trainers, who have been trained in three-full day human rights training conducted by the NHRCM from 29 November 2017 to 1st December 2017;
-Produce and publish handbooks and guidelines designed for staff of executive agencies of court decisions in order to provide them with the human rights education and to use them in further human rights training and promotional activities.
In addition to conducting inquiries into detention centers and prisons of the GAECD in order to prevent from or to eliminate any violations of human rights and freedoms that are enshrined in the Convention against Torture, two parties have agreed to cooperate on the following areas:
-to discuss any complaints submitted to the NHRCM regarding a violation of human rights which took place during the execution of court decisions, along with its solutions, twice a year;
-to take necessary measures to eliminate the violations;
-to conduct a statistical study on prevailing violations revealed by the inquiries and to exchange information promptly;
-to ensure the labour rights of staff of subsidiary agencies of the General Executive Agency of Court Decisions.
